In the grand jury, “A” testified that the oral sex took place at a public pool. At trial, he said it happened in Nickel’s bedroom. The reverse is true for the ‘finger’ charge: In both Investigator Bates’s contemporaneous notes of the first interview with “A” as well as Investigator DeFrancesco’s deposition based on that interview, it is clear that “A” initially claimed that it happened in Nickel’s bedroom; but at trial, he testified that it happened at the pool.
